“User-Involvement, No More Rhetoric, Tokenism and Excuses; It’s time to ‘go-beyond’ policies and procedures towards ‘Implementation’!!!”

Policy Statement on Mergers, Collaborative Working and Due Diligence

This Charities Commission policy statement is very important within what we're trying to implement within our work in the Disabled peoples', NeuroDiversity, Mental Health ‘Survivors’ and Inclusion movements and our ULO’s.

We need to 'voice' our concerns assertively on where we stand within 'Nothing About Us, Without Us' and ‘Whistleblow’ to the Charities Commission, that now all Charities have to legally show due diligence in working 'With-Us', Not 'For-Us' and are accountable 'To-Us'.

All Charities are now fully legally accountable, under the Charities Act 2006 to All Disabled People and all their ULO's, such as Hull and East Riding Mental Health Action Group

Reforming the Legal and Regulatory Framework - taking forward the Strategy Unit Review ‘Private Action, Public Benefit

As you can read in 2002 the Cabinet Office Strategy Unit carried out a wide-ranging review of the legal and regulatory framework of the not-for-profit sector, of which charities form the major part. The review’s objectives were to:

  • enable existing and new not-for-profit organisations to thrive and grow;

  • to encourage the development of new types of organisation;

  • and to ensure public confidence in the sector.

The result of this review was within report, ‘Private Action, Public Benefit’, published on 25 September 2002, and containing a number of recommendations, some of which required legislation. The Government published its response to these recommendations in July 2003, and on 26 November 2003 the publication of a draft Charities Bill was announced in the Queen’s Speech.

The five crucial themes in these proposals which impact on the Disabled Peoples', NeuroDiversity, Mental Health 'Survivors' and Inclusion movements are as follows:-

  • Accountability and Information – making both charities and their achievements, and the regulation provided by the Charity Commission, more accountable to the public;

  • Clarity. The new proposals about charitable status will make it easier and simpler to understand what is charitable in law;

  • Modernisation. The proposals preserve our ability to adapt what is charitable to the demands and needs of modern society;

  • A new fillip for social enterprise – both through the new purpose of promoting community interest and through providing new or better working precedents, which are more realistically attuned to the delivery of social enterprise;

  • a sense of proportion in regulation – the bill will enable greater freedom for charities in areas like expenditure of capital, coupled with duties of care on trustees.

  • The vision of a purposeful regulator, sited independently at arms’ length from the sector and government.

***So this clearly means accountability towards ALL Disabled People and their ULO's....., especially ‘in line’ with 26.9.07 - DoH/CSIP's Prime Ministers Improving Life Chances meetings and final report.

As Tara Flood, ALLFIE , stated to me, there is ‘good and bad’ research out there, that needs to be self-regulated and monitored, sustainable and implemented under the full control and hands of ALL Disabled People and their ULO’s. This reminded me of The Secret History Of User Involvement , Part 1 and 2, by Peter Beresford, Professor of Social Policy at Brunel University, and long-term service user. (also “Involvement in Research: Connecting lives, experience and theory”)

As the author of this article, I state very clearly that it is time for ‘respect and dignity’ and full acceptance of “User-Involvement. The time is right. No More Rhetoric, Tokenism and Excuses. It’s time to ‘go beyond’ policies and procedures towards ‘Implementation’!!!
